I was charged Class 1 misdemeanor with battery at California. If I finally reject DA offer (only waive Jail time, but keep the same charge and 52 weeks anger control classes plus 3 yr probation), I have to go jury trial middle of July.
My wife and I just kid around at our apartment, she suddenly scream as pee on pants. (probably from my holding, but at least it is un-intent accident) but she did not tell me the reason that time. As she scream very loudly like be out of control. I try to comfort her but no result :(. Then 2 neighbors call 911. Cop comes, my wife said we kidding around, but not say the real reason for embarassment, sure there is no injury, no mark. But I am so stupid to describe the detail and said word "drag", In my poor English, drag is not that serious. Actually I just lift and hold my wife and try to move her to study room as she want to go there. That's all. But that time, I did not realize that serious. That cop record I am irritated and drag my wife's hand and push her to computer chair ( I really not said that push to chair thing), then she screaming! I was immediatedly arrested that time and leave the fingerprint at police office.
Then I hired a criminal attorney, but DA refuse to dismiss or reduce my class 1 level charge. Only waive the jail time. My attorney said my own statement is not good for me and easy to be attacked.... he tried to persuade me accept offer... :(
I feel really upset but hardly to accept DA's plead to guilty offer. Both my wife and I think I did nothing wrong. Now my wife try to contact DA through email.
I prepare the worst thing, if lose the case in jury, will my GC gone? I filed 485 last June and fingerprint August/2007. The arrest happen at earlier March. And worst case, will I be deported immediately? Now I still in H1, expired at 2011.
Really appreciated if you can give me any advice.:(

I would sympathize with you if you can do the following:
1) Show me that no more than 90% of the population experience depression tendencies at some point in their life.
among EB applicants I believe it would be 99%. So are you alone? I guess not:D:D
Things you could do: Try watching talks with the Dalai Lama (available on youtube). Read books on Gandhi. Increase frequency of quiteness / meditation. Watch atleast one comedy show per day. Visit/remember the sick/disabled/poor or other less fortunate people than you.
Things you could avoid: Heavy drinking. Watching news, movies/shows which are high tension. Most important is not to fight the emotions/thoughts that you consider are destructive. Allow them to come and go. Just watch them come and go........
What you consider as "Good luck" can happen to you in the fraction of a seccond, however, it will never happen if you keep on defining yourself as unlucky. So focus on the good things you have now and refrain from comparing to "what you should be having or are worthy of having". :D:D:D:D

As somebody said above, if we r getting married after Aug 17, and if we decide not to file my 485 now. My PD is May 2007 and my 140 would be approved before my H1B is expired for the second term, and if I didn't file my 485 by then, what kind of H1B extensions would I get ?? 1 year or 3 years.

As far as I know if the USCIS issues a receipt of your I-485 they are under the impression that your GC is around the corner irrespective of PD's...Could someone please throw some light on this issue??Would really be helpful for some people to file/not file their 485's....

If not expunged, it will FOR SURE pop up immediately they punch your name in. You certainly can not lie there. You will be deported. If expunged, you still have chance BUT NOT to lie..If the form ask " If you have ever been arrested" say yes and as others suggested have all your documents ready from court but make sure you have all originals and notarized documents if required for all court orders pertaing to your case.

I highly doubt they pull up state criminal record at POE.
If its a federal crime, then i can believe that.
However, this shouldnot encourage you to be dishonest at POE's or visa interview.

This list is not all inclusive and only includes the House races that have been listed on the Cook Political Report (www.cookpolitical.com) as competitive. I have been thinking for a long time to own a gun but due to my H-1B status could'nt own one. My I-140 was approved last year and now I am working on EAD.
I am wondering if anybody else in a similar situation purchased a gun; I mean after he/she started working using EAD. I tried to research the issue but the law is not clear on the subject.

No point in showing frustration. Its not our birth right. We all were well educated before we came in here. Situation changes. And system makes an adjustment. Dont blame your country( I am also from India), for no one asked us to move out. There are so many nice positions available to work for. More than 80% of us found here a better oppurtunity, because there were no competition at all in getting jobs. 1st come 1st serve.
So do not complain. They do not have any urgency to hand us over the GCs. We can only request them to do the needful on the basis of our sorry state of affairs. Again, we are still at their mecrcy.
So stop complaining. Either wait and support IV or boot out.

My wife applied for LC as Business Analyst with Bachelors and 5 years of Exp.
My wife has done her Bachelors in Engineering from Bombay. She had more than 7 years of exp at the time of filing. The job required 5-7 years of exp with abachelors Degree.
She applied to Atlanta center and it took around 5 months and no audits that we know of. thenshe applied for her I 140 which took around 3-4 months. There was an RFE for exp letters since the lawyers did not give it during her I 140 filing. After the lawyers responded to her RFE, her I 140 was approved in 15 days. Now she is waiting to apply for I485.
I hope this gives u an idea that u can apply for EB2 as BA if the job requires Bachelors and 5-7 years of exp.

First it wasn't 1000, we had over 2000 people registered and many joined after or did not register. So please don't say 1000, it is extremely painful for everyone who attended to be considered as "not counted".
1. Politically having a rally in D.C makes it more visible for all the law makers there. Laws/amendments and all the political activity happens there. Rallies else where would make it to one or two news cycle but won't be remembered after wards.
2. Meeting lawmakers, staff from various constituents wrapped around an event like a rally helps a lot in getting the message across. It raises a lot of awareness.
3. I would have agreed with you that numbers like 100,000 matters, but after being there and seeing the amazing capabilities of IV to organize meetings and having members meet over 100+ meetings with law makers, staff, talking to to them, sharing personal stories, advertisement and media campaigns around D.C has convinced me that it has and will make a difference! Personally for me, it was an eye opener on how the system works and I totally understood exactly why IV leaders set it up this way just by being around and them for a few days!

ok - 1,000 folks (none of them voters) are asking me for a comprehensive employment based GC reform......which is a pain in the .......!!
2,000 excited parents (85% of them registered voters) are asking for a new ice skating rink at a local school or residents of a neighborhood (again 65% voters, accounting for immigrants among residents) want a new station on commuter rail line or a new bus route or whatever......all of them easy to achieve.......
and the lawmaker wonders over a cup of decaf latte - what should i focus on......??? to him/ her - the choice is obvious.....and if it is not obvious to us........we should take a reality check.....
It would be a different thing - if 100,000 people do a silent lunch time gathering within the campuses of a revered american company like Cisco or Msoft.......with organizational blessings......people would sit up and listen.....
Personally, I did not attend the DC event because I was travelling on business and to me my perceived benefit (maybe wrong) of rally was not worth postponing an important business trip.......on the other hand if one day it so transpires that this rally was the historic starting point of major immigration reforms triggered by a group of pioneering individuals - i would have no choice but to eat my words and hang my head in shame that i did not attend.............

Hi Pankaj,
Was your case rejected due to the number of years of education (10+2+3+2 = 17)?
What if it is 3 + 3 ( 3 year Bsc Physics + 3 Year MCA) 10 + 2+3+3 = 18? I am wondering if USCIS would consider this equivalent to US masters? Came across a memo used by Nebraska Service center that says USCIS would consider 3+3 equivalent to US masters, but that memo was from 2006.

My case they rejected because i have 3 year Bsc and 2 year master now funny thing is that i know my friend who did similar course from same university but he did same master degree like me but in part time so he complete in 3 years and he got approval in 2009.

You are right -- 3 Year Bachelor + 3 year Master (in related field) is good to go. 3 Year Bachelor + 2 year Master is unlikely to sail through.
In this case, OP need to establish that his/her Masters is 3 years.

One of my co-workers started me with a gun range membership...you can even find ones that dont require membership...just show ur drivers license and rent guns from the range & dont worry about carry permits...etc etc
