    Hi,

    Is it possible to apply for both PIO and Indian visa simultaneously. My problem is that my son born in US has to go to India in 60days. If I apply for PIO and if it will not come in 4 weeks is it possible to apply for Indian visa and then go to India on Indian visa ?

    My lawyer is saying that even if you want to file I-485 now, the USCIS has advised Fedex and UPS not to deliver any mail to that PO BOX. In that case I am not sure how one could become member of the class action law suit.

    There are no bills being discussed. House as well as senate are on recess and will convine after Sept 10th. After it reconvenes, between 10th sept and Oct 8th - it has a lot of tasks at hand, and no apetite for any big and controversial issues like immigration. Mid term elections are in early nov and nobody wants controversial bills debated just before that. Morover it has been made clear that GOP does not want any immigration bills except "fencing the border". Democrats do not have required votes for cloture.

    So, nothing is going to happen on the immigration front- legislatively untill after nov elections. Attitudes towards this issue will change and more GOP Lawmakers wil favor talking about this after. It will be a different ball-game depending on who keeps the majority. In the lame-duck there might be a chance.

    House - August 9 – September 12
    Senate August 9 – September 10


    Target Adjournment:
    House - October 8
    Senate - TBD



    So, between now and the lame-duck session, if we can educate lawmakers- especially now- since they are comming back home and to their constituents in the recess. Most of them have town-hall meetings arranged and want to hear from their constituents. It will be good to make ourselves visible and heard.

    This is still not a big deal.

    Firstly, the lesson learned from this is, dont show your H1 to the officer at counter if that H1 is expired and you are entering on AP. The officer doesnt care what your history is and how many beautiful H1s you had in past that are now expired. If you are entering into US using advanced parole, then show advanced parole. What is the point of showing an expired H1 stamp?

    Secondly, as far as JFK is concerned, that airport seems to have procedure that all AP holders are processed in back office (secondary inspection office) and not processed at the counter. In my case, as soon as the officer saw an AP, (that first thing I showed him even before passport and the I-94 filled out), he said "oh parole ... let me grab that and walk down that room", he put all things (parole, I-94, passport) into a plastic bag and took me to a back office. There, another employee entered AP info in the system, stamped the AP and gave it back to me. It did take about 10-15 minutes for them. But they didnt ask any questions.

    So, try to make it simple for employees at POE by showing them the authorization for re-entry - WHICHEVER it is. If you are re-entering on H1, then show them h1 stamp that is valid. Dont show AP. If you are re-entering on AP, then show them AP and TELL THEM you are entering on AP, rather than flashing an expired H1 stamp.

    Thirdly, this isnt a nightmare, the guy was processed in downtown office, and took a few extra hours. Big deal. Yes, its a hassle, but one must act professionally rather than throwing tantrums like "let me in or let me go back to my home country". That's NOT how government operates, definately not at that level. There are procedures in place. Emotions and rhetorical outbursts are not going to sway the decision. If you have the right authorization to re-enter, then you will be let back in, there is no other alternative. If you dont, then no amount of rhetoric and outburst is going to save you. The decision is driven by paperwork and not by the impression you create on them. The impression matters when you are getting visa for first time in US consulate. But at POE, its more procedural and there isnt that much discretion and leeway to deport people back.

    If you want to throw tantrums and use rhetoric, then there are plenty of places to do that, and I'd suggest you start with your congressman and senator's office. Go there and tell them that let's end the probationaly shackles on skilled immigrants and regularize them in American mainstream OR if they are bad for america, then send them all back. That's where the rhetoric and emotional tantrums might work. They wont work at POE at airports or in USCIS offices.

    Calm down people, use AP freely and peacefully and also EAD. AP is not just used by us, it is also used by family and marriage immigration cases. Many people get engaged, come here, then get married and then file for green card based on marriage to citizen. Even they use AP. In fact, they have no other choice except AP for re-entry as they dont have H1 or L1 alternatives.


    Excellent points. We also have to remember that these issues could be confusing for the immigration officers too. With the current backlogs these guys are going to get more and more on the job training.

    You will also see "Approval notice sent". It means the card is on the way to your mailbox.

    I feel for all of you whose EAD is not yet receive. When my EAD was pending for more than 90 days, I wrote an email to the Ombudsman. I don't know if it helped or not. I just got RFE notice 4 days after sending the email. After replying to the RFE (photos), I got my EAD with no problems.
    When does the "Approval notice sent" status appear, it is about 7 days since I got the production ordered.

    Your good fight on the retrogression issue kind of kept us going without giving up. In just a few days what some of you have done with www.immigrationvoice.org is amazing and it truly deserves a lot better than the faint response they have got so far from all of us in this legal black hole. Honestly, I do not care if we are not able to raise 100K dollars for the lobbying efforts for the next immigration bill on February. I don not care if this money is finally lost. It will be money well spent if we all realize that we have to do something instead of waiting years and years and years� Any money is worth the effort regarding our goals, even if our present intention does not succeed. Is worth it!!. Lets move on, hoping for the best� It is worth to try this next immigration bill. Any money spent on this is worth it� Can not you guys see it? More and more years on this black hole!! More years paying our lawyers for H1B renewal, more years for renewal of our driving licenses, more years for our wives to wait, more years for our employers exploiting us� This next immigration bill could be our last chance in many years to get our unfair and sad situation known and probably solved. We would at least raise enough concern about the absurd situation of the legal immigrants� It could be a new Quixote tale, I do not care� A good part of my next paycheck will go to immigrationvoice� Whatever� Keep America growing� America is not just them�. It is all of us� It has always been� It is what America is made of�

    Hello,

    With me having a pd even prior to of Mar 2002-EB3I, I thought I will join hands with IV to make something happen. To the extent I went and joined the IV chapter too.

    Unfortunately, starting with the forum to most of the news that is being discussed seems to be not related to immigration at all. Example, accidents, investments, real estate. I feel the admin should be able to control and strictly adhere to what ImmigrationVoice stands for and delete any other unrelated threads.

    Anyway, long story short, I feel IV has lost its focus and feels like for people who are looking at a proper approach to resolving problems, the web site does not give any reason or confidence, to follow or join hands for IV activities.

    Just my opinion. Feel free to agree to disagree whoever would like to.

    Not trying to blame anybody here, but sharing a viewpoint. In my opinion IV was great sometime back, but feel now there is a lack of direction.

    I understand there could be lot of negative & positive comments about my reply here or me joining activities etc or not joining IV initiatives etc. I will explain my stance on those later.

    It is silly to think filing lawsuit will cost $100. If I could do it myself I would have done it already. Filing potential successful lawsuit requires successful attorney to prove out a point. They are familiar with laws and their interpretation. They are good at explaining those interpretations. They do it day in and out. My job is not to file is lawsuit. I leave that to pros.

    Somebody will be foolish to think I don't IV. I need IV now more than ever. IV has establisehd a base and some sense of direction of where to go. Why would I want to start myself and re invent this wheel? IV has base with support of members, access to lawyers, voice in the world where I am just a pawn etc.

    But, more seriously thinking, isn't Mexico also one of the backlogged EB countries? I doubt they will mind having a provision for us while they do their campaign. Perhaps we really ought to join hands with them so our objects can get more widespread support .. just an idea

    Mexico is lobbying for all out amnesty. Their backlog is far lesser .

    In my case, the request was processed at the local branch. I don't recall seeing an option on ICICI to do the wire transfer. But assuming there is, you should give that a shot. You might have better luck at the branch though .... RBI has the so called KYC - Know Your Customer rules for all banks and that may give you some leeway.

    Did you mean the local ICICI branch ? I would appreciate if you could let me know the process that you followed to get the money from India.

    Only use applying for 485 now single is to be eligible to apply for EAD anytime. And if your spouse decides to study (F1) or work (H1), you can apply and get your EAD and use it. Once the PDs become Current, you can add her case (AOS) and her EAD too at that time.

    If you think that your spouse would remain on H4 no matter what, then you are correct, there is no use filing 485 alone now.

    What say ???

    "you can apply and get your EAD and use it" what does that mean???your wife can still change her status after coming here on H-4 irrespective of whether you have applied/not applied your 485. EAD is of no use to you coz u r already working...It is only of good use if your wife can work!!!

    There were many I-485 applictions from EB2 ROW from 2005/2006/2007/2008 pending (some stuck in namecheck, some just filled in rack and some waiting an IO). All these applications where getting approved in 2009. Recent trend 2008/2009 I-485 EB2 ROW apps are getting approved (meaning not many old apps left).

    Going forward EB2 India/China should see forward movement (and if i can esitimate right big numbers for year 2010 if recession continues).

    It could be true that those ROW app will be around 22k so no cut off dates adn there will be very less spill this year. So really slowdown in economy helped them a lot. Next year if economy continue to be slow then it may help india lot. but not 100% it will clear backlog.

    We need recapture to clear all backlog.

    Yes but in Canada you will breathe clean air and drink clean water. You will have electricity 24 hrs a day and water 24 hrs a day. You wont find trash on the street and you wont be considered second class citizen if you arent SC/ST/OBC due to reservations. You woint have to give "donations" to get your kid admitted to Class 1. You wont face a system where a simple court case drags to 50 yrs or a case where doctor will not treat if before police does a "Panchnama" if you had an accident. You wont have to bribe everyone from minucipality to police to start a business.

    I have driven in and around Toronto for a couple of hours and did not find it much better than driving in Trivandrum/Cochin.

    Other points, I can only talk relating to the US and here we go.
    "you will breathe clean air and drink clean water." - The air in the US is as polluted as that in India as attested by the rising level of Asthma and the repeated Code Red warnings during summer time. Almost same story for water. About a year back, the DC govt. even admitted that the water supplied by them contains too much bad stuff.

    "You wont find trash on the street" - only when you live in a decent community. Just walk around half an hour around NorthEast DC and hope you will change your mind. Do not attempt to walk around the downtown of any US city after 6 PM. We don't want to loose any of the IV members.

    "you wont be considered second class citizen if you arent SC/ST/OBC due to reservations." - Who is considered second class citizens is a subject unto itself. But if you are complaining about reservations, you have never heard of affirmative action.

    "You woint have to give "donations" to get your kid admitted to Class 1." - Agreed public schools are free, just like they are free in India. If you want your kid to study in a private school, please pay $5000 per year.

    "You wont face a system where a simple court case drags to 50 yrs" - I had prefer a case dragging for 50 years or more against a wrong court decision such as we saw during the 2000 US presidential election.

    "a case where doctor will not treat if before police does a "Panchnama" if you had an accident" - I think the situation in India has now changed regarding hospitals refucing to treat people due to police case and such. Now, all hospitals (private hospitals included) are required to treat traffic accident victims asap.

    I am not trying to say, India is paradise. We have lots of crap going around. Many things still stink, but so is the situation in many "great" countries.

    I am exactly doing the same thing that anandrajesh mentioned above. I have my tickets booked for Nov 21st and its already more than 60 days for me. I have called them to expedite it. will be faxing the documents and letter to local congressman and uscis ombudsman today. I am not even sure why we pay so much of money to these people and do all this to just do their work. But what can we do, we are at their mercy.

    wow! I am worried about my case now. I booked tickets for Nov. Its 45 days and I haven't heard anything. I will have to expedite in about 15 days from now. I can't imagine canceling my tickets after 4 years.

    I agree. It sucks! Its like begging for something that they are supposed to provide anyway.:mad:

    LOoks like the AILA link does not provide email addresses for every listing. I have sent emails to 4 media outlets in my area in Colorado.
    yes it will not give you email addresses for everyone. but some key people will be listed. plus you can go to the website of that org and get details from there. without this tool it is v tough to find media contacts.
