Is there anyone who got an appointment letter recently from Amercan Embassy, MUMBAI?
My interview is scheduled on 22nd Aug but not received letter yet.
How did you know that an interview date has been set for Aug 22? I have contacted the embassy and am still waiting to hear from them beyond their auto-reply.

This is one of the most important bill for all our current chronic problems... once we get to solve these with this bill... we can focus futuristic goals as mentioned in IV list.... IV admin should make this an important thread and follow..encourage people to follow with congressmen and senators.

Thanks! That's helpful... from what you say, sounds like PD is still quite important. RD comes into the picture only after the PD becomes current. However, if a range of PD's are current, then they would sort those by RD and not by PD.
For eg, if they move the dates forward by a year, and Jan 04 and Jan 05 are both now current, a person with PD of Jan 05 but an earlier RD would still get processed prior to an application with PD Jan 04 and a later RD (according to the FIFO principle)...

I know, it is unfair and frustrating. But from legal point of view, you are mixing Employment Laws with Immigration Laws.

These ppl are talking about giving amnesty to ILLEGALS...let me repeat it.. amnesty=award for being ILLEGAL. They have done that before and all of a sudden we F'KIN LEGAL TEMP WORKERS from India/China have to worry about the LEGAL aspect of filing a law-suit.
Something is seriously screwed up with this. This is no different than a pseudo-SLAVERY. Now all of a sudden most of you will say, no one put a gun on your head to work. Ofcourse not, but why hell do they create a dual intent H1FU?K Visa where they show you the carrot and create a indentured servant system and discriminate on the basis of the country of your birth. It is very unfortunate that people equate job opportunities to the population of the country. If that were the case then India and China would have the most job opportunities in the world because they account for one third of the world population but that's not really the case otherwise we all wouldn't be here in the first place.
Opportunities are defined and provided by the economy. When you compare Canada to US, you might say that it's a smaller economy but remember Canada is a G8 country with such a strong economy that most other countries in the world can only dream of. US is the richest country in the world with the strongest economy so obviously other countries don't offer quite the same opportunities but Canada offers things that has become a dream for many of us... to be a citizen of the country where to permanently reside. Canada offers stability, certainty, hope for the future, and and an opportunity for everyone in your family to realilze their dreams as opposed to sitting at home for years doing nothing hoping that one day that EAD will come. Canada respects immigrants and welcomes them with an open arm quite contrary to policies in US where you are allowed to work but your family is not and even you are kept on the state of limbo for years and years wondering what your future holds in years to come. And better yet, you abide by the laws, pay taxes, do everything by the book yet the guy who just walked across the border has much better chances of becoming a permanent resident than you. Where is the respect and fairness for law abiding folks? That my friend is what is different with Canada. You get treated with respect and dignity and you get to decide what your future holds and not the US government.

I hate to burst your "bubble of hope" but Canadian population and job market is limited and the opportunities for professionals like us are limited. Why not consider going back to India and taking up some of the lucrative opportunities in middle management in the IT industry.

I don't think they mean to say that High tech workers are illegal. They say that their poll indicates Republican voters who earn more than $75000 would like a candidate who opposes illegal immigration. Atleast, that is the way I read it.

I received my EAD last month. But no AP yet. However, i received an email from my lawyer today that.....my AP got rejected. The rejection letter is saying that I485 got approved that's why the I131 is rejected.....therefore, my lawyer is waiting for the I485 approval.....but my lawyer told me that I can expect my card soon.
I don't know how to react. The online doesn't have any update about the I485 status yet. They received my application on July 2, 2007.

One thing that forces you to believe its true is the date itself, why 8 MAY ? it somehow paints a picture that somebody did calculated the remaining visa numbers and arrived at the exact comfortable date. Guys, chances are its fake, but you never know. :)

Following the rules as they are doesn't imply there's no injustice or congress can just shut shop and go home. Giving unused visas from EB1 to EB2 is just following rules as they are - just as giving preference to Non-Indian's first is. I get to meet plenty of EB1 & EB2s who are just plain retards so its not 'obvious' that they're going to 'benefit' the greater society at large though the rules were framed hoping that would be the case. Also, EB3s def. have to be labor certfied so they're not displacing anyone - the whole system is such a mess and is being abused so much that things that ought to be obvious & taken granted for have to be reiterated again & again so its just dumb to say 'EB3 is the least qualified of the three and is also the most likely candidate to displace an American'! And if theres a sudden glut in the labor force and plenty of native born well qualified work force is available, there shouldnt be anyone in the GC queue to begin with so there'd be no reason to do away with any quotas - unless one presumes people will be abusing the system all the time.

One more thing, only desi consulting companies are not the problem. Companies who figure out a way to take advantage of its employees, will do so. All companies are in the business of making bigger bucks for its shareholders. If they can figure out a way to make more, they will, even at the cost of taking advantage of immigrants. Desi companies figured out the loop holes first. Some of the other companies followed, others are still learning. It can be argued that % of such elements in desi consulting are more because they were the first to figure out the loopholes. But desi companies are not the only group taking advantage of immigrants. They are all the same. And folks like yourself feed into the problem. So please stop blaming just the desi consulting companies, because all companies are the same. Some companies have not yet figured out the ways to take advantage of immigrant employees. But these comapnies are learning fast, because they want to be competitive, right?
The actual problem is, the Congress. Lawmakers are the problem. They know everything what is going on. They know that not just desi companies but even larger companies take advantage of the vulnerable part of the society - the immigrants. I just want to make sure that IV not forgotten People that stuck in PBEC. So far as an active member and an active contributor for IV I have to say that I'm dissapointed as far as the way IV addressed PBEC Issued.
Most of disscussion in IV forum seems like focusing on retrogression issue only.
for people that have their case are among 350000 case pending in PBEC the retrogression has no effect at all unless their case clear out before the retrogression get solved.
There are so many of us had been waiting for their labor get approved.
5, 6, 7 year are a long wait.
I noted that IV do have PBEC mentioned on the web fax, but please make sure that retrogression is not the main goal of IV.

What kind of charges may be filed under the following points?
1. Processing and approving 60K I-485's in 2-weeks (12 times normal speed) just to avoid the flood of applications in July, when you consider that their typical speed is around 10K/month. 25K applications were approved in just 2-days (37.5 times normal speed) over the last weekend.
2. USCIS requested visa numbers for cases where FBI background check was not completed. In other words, they requested numbers before processing could be completed for those cases and I-485s could be approved. Serious issue of lapse of national security here.
3. USCIS apparently approved I-485's of some people whose dates were not even current in June, even if their FBI check had been completed and I-485 otherwise ready for approval.
4. USCIS apparently approved I-485's of some people in July after DOS published the updated visa buletin on July 2nd advising that all visa numbers were exhausted for FY 2007.
Any other points, and possible charges in the lawsuit using those points?

Everyone has the right to speak and if other Nationalities want to wish their fellow countrymen on their festivals they should be allowed to do so. You can subscribe to CRIS email for status updates. But sometimes you may not get the email. The letter may directly go to your ex employer's Attorney.
Even if you get a NOID, it may go to your ex employer's Attorney. We all know this employer attorney nexus - they are ready to screw you.
