I have to agree with you on this. Its not like Bollywood did not make movies before Danny Boyle made one about slums and poverty in India. There were so many good movies made by Indians with not a single white or foreign contribution, but never even released outside of India. It took a white man to come and show the world the poverty stricken children of India that the world stood up and took notice.
My hope is that things will change now. Just as the world has realized the technical talent Indians have in IT and Business, my hope is that they realize that we have others talents too!

Seems like MOtor Vechile dept is fianlly caught up with the Retrogression. I have been driving with Temp DL past 5 months. I was thinking it was the random check but this thread makes sense to me now

Shoplifting does not divide EB population. But if you open a thread to pitch EB3 against EB2 then I think he should be banned. I can click the red triangle on top of post to report it because I do not think anyone in IV or any senior member has time to waste all day reading every post and deleting them.

As you all know, they ask me to sign their contract in which its mention that if i leave their company before 1 year then i need to pay them 15k. Thy also charge me 3k for my H1-B which i am still paying everymonth from my paycheck and we have 70/30. In just six months i am so much fed up with them. These people are so rude...always show their arrogance over phone. I have no libarity to find job by myself. They always looking for higher pay rate sp that their big money tummy get filled up.and i also feel that they didnt told me the right pay rate for the project i am working on right now.
I really want to leave them, Even before 12 months. Is there any importance of that contract letter i signed with them?. Can they Sue me? What are my options? Please suggest me.....i am in stress.

Welcome back UN. One question. Does the USCIS have ability to check credit histroy.
There is nothing in the law; where USCIS can deny a person's 485 due to bad credit. Therefore, they wouldnt' have any interest in checking this.
They are on record that they will check publicly available information in help adjudicating cases. They usually; do this on h-1b petitions. They'll check the company web-site; company registration; whether office is in a house, virtual office, web-site of company giving purchase order, etc. They frequently quote whatever they find in denying cases.
I actually came across a case where a company had 14- denied for ability to pay.
There was a merger between companies and the new company filed the 140 using old companies labor.
In denial; USCIS said they didn't believe the merger because a search of the california business portal showed that the old company renewed their business registratoin (evidence that it wsas still in business);
since, president of the company had same name last name as person being sponsored; USCIS actually retrieved the president of the companies greencard applicatoin from 10 years earlier and quoted that the candidate and president were brothers because according to their g-325a's they had the same parents. They denied the ccase and invalidated the labor due to this.
I remember back in 1994; IRS said that they were going to check peoples credit applications and comparing to peoples tax returns; they were going to try to compare the income people listed on their tax returns to what they were putting on their credit applications.
If USCIS was going to try to get credit files; it would be in order to compare work/address history with what a person has put in their applications. However, they have a lot of other ways to verify this that they wouldn't need to go to a persons credit file. I know with the economy the way it is; people seem to be worried that declaring bankruptcy or having negative credit history affects their 485. However, not paying debts isn't considered criminal that it would impact a persons applications.

Well, DOS is alerting that don't expect additional rapid movement any time soon. Here is the relevant part of their warning:

Once number use increases significantly as CIS addresses its backlog, cut-off date movement will necessarily slow or stop. Moreover, in some categories cut-off date retrogression is a particular possibility.
The only positive thing I can take from this visa bulletin (assuming there is even a modicum of linear thought possible on the movement of dates) is that the 485 traffic for PDs between 2002 July and Jan 2003 is fairly light for EB2 India. After all they stated as much in their footnotes about anticipated movement of PDs. This can be construed as offering some hope for those from EB2 India with priority dates in early 2003 (say up to march). After all anyone in their right mind would not chance CP now with the fluidity of priority dates and the pending BEC deluge of cases, and the hordes of people hunting labour subs. etc. Basically if anyone gets the chance to file 485 they will do it lest the dates retrogress again while they are waiting for the consular interview.
So those with early 2003 dates can be hopeful now, later than march and I doubt you will be in this fiscal years quota.

It would get attention and help in educating (legal vs illegal) and would be done in conjunction with other things like:
-sending more flowers
-a huge rally in Silicon Valley
-candlelight vigil at congress
-mass letter mailings from all of us
-human chains
-hunger strike?
-etc
We have to attack simultaneusly (but SMARTLY) from all angles in order to be effective!
It would get attention and help in educating (legal vs illegal) and would be done in conjunction with other things like:

-a huge rally in Silicon Valley
-candlelight vigil at congress
-mass letter mailings from all of us
-human chains

Thanks! That's helpful... from what you say, sounds like PD is still quite important. RD comes into the picture only after the PD becomes current. However, if a range of PD's are current, then they would sort those by RD and not by PD.
For eg, if they move the dates forward by a year, and Jan 04 and Jan 05 are both now current, a person with PD of Jan 05 but an earlier RD would still get processed prior to an application with PD Jan 04 and a later RD (according to the FIFO principle)...
PD is the basic qualification and after that its all Luck .....Its a lottery ...
