I first immigrated to Canada, got my citizenship and then came here to the US and am languishing in this stupid GC queue for the past 7 years..
Inspite of all the freedom to go back to Canada, I would now, rather move back to India than any other place...
Forget the little hardships in India..what matters is that India's IT economy is booming...booming like probably no where else in the world!
Why not, go back there, repay the country that gave me all the skills in the first place, and at the same time participate in that booming economy?
I agree with the sentiment. But the reality is many immigrants who evaluate the canadian option would want the paperwork that you have. Don't indian citizens, like the Chinese, require a visa to visit EU countries, commonwealth countries such as Australia, Fiji, the carribeans, pretty much anywhere in the world? Especially the more entrepreneurial ones amongst us all would want easy access to western markets and eastern talent pools. Sure it's still manageable to foresake what you got here, but I really want easy travel documents and the freedom to choose where I live and work.

Green Tech, There is a history of posts with buddyinfo alias buddyinusa alias buddyinuk etc etc. This guy has a background of sounding like someone from India, and attacking specific community, pitching one against the other, which it typical terrorist mid-set. The other day he pretended like someone from north India and attacked people from AP. He was also supportive and sympathic towards terrorist who attacked Mumbai on 11/26. Based on that history, I read between the lines whenever he post, and I see it in that light. Others in that category are sab and gcisadawg. I hope it explains where I am coming from.

Thanks just4gc for giving me the coveted vdlrao post. I must say the ages spent analysing Visa bulletins statistics and congressional testimonials of Charles Oppenhiem have finally borne fruit ;).
I guess Illusions beat me to the prediction. I must confess I havent spent a lot of time looking at Eb3 ROW. But even then I was surprised when it stayed at May 05 for as long as it did. The Backlog Reduction Centre stuck labor, the horizontal spillover, the Eb2 India backlog are few factors for why I was surprised.
I would say dont lose hope on Eb3 ROW, but until Eb2 India backlog stays it will be slow movement except as illusions pointed out in july 09. Last VB mentioned 60% of the demand recieved is before jan 2004. Thats pointing to the older BRC cases which are now seeing the end of the tunnel. fingers crossed.

I'm confused about the way the spill over works. Does it not go from EB1-ROW => EB2-ROW => EB3-ROW? Your post suggests that EB2-I gets the ROW spill overs before EB3-ROW. Is this the way it works? Sorry for the questions as I'm trying to understand how this works. Thanks for your response.

yea i hope USCIS completely cleanses the system and gets things back to the way it was pre - 2000
except for mayb 5% of the bodyshoppers ( i could be wrong as i'm not frm IT , have friends who tell me etc) rest all 95% commit fraud to some degree or the other

Look, the H1 quota was not sufficient even when it was set at 115,000 pre-2000. It was only when it was set to 195,000 in 2001 that the quota exceeded demand. Now thanks to the report by USCIS last year, we know that about 20% of the H applications had fraud or technical violations. Even if you assume that the USCIS does a perfect job and catches this 20%, the quota that will be freed up won't be enough for the rest of the applicants.
The issues we face have less to do with fraud and more to do with the anti-immigration forces who dislike the 1965 immigration law. Claiming fraud, cheap labor, harm to the environment from increased population are just convenient means to couch opposition to permanent immigration in.

Hello,
i am lawful permanent resident. I want to bring my parents here permanently. I got nobody in India to take care of my parents.
When i was small, my parents took care of me. When i need them, they are their for me.
Now my parents need me. But i am not their for them. I feel very guilty and sad. I want to bring my parents in US. So i can take care of them.
How can i bring my parents permanently.
I know, i can bring them after i get citizenship, that is too long wait.

i saw some petition signed by many Indians for this request. Can somebody please go forward with this.
Current president will understand our request and help us. He is very nice and kind person. He loves family and his mother in law lives with his family. He knows values of grand parents.
Indians live with family, that makes Indian family stronger and less divorce. And Indian kids are well taken care by grand parents. So they are well behaved and best kids.
We need this permission. Please work together and get this permission.
I read this in a website. Is this possible? I want to explore all possible steps.

Sorry to hear your story dude. You just met a jerk of a law enforcement official - they are in the minority. Most CBP officers are better than this. Several years ago i too met a jerk like this in an airport in the southeast. I was entering on H1-B, he kept saying that my employer (a reputed american company) was disloyal etc... as he was processing our paperwork. First he grilled my wife, then he started with me, i just responded to him with a disgusted facial expression.. answered his questions rather curtly when asked, did not respond to his rants. His rants were not framed as a question - so i don't have to answer it. All this lasted a total of 5 to 6 minutes as he was checking and stamping our passports.
BTW, not seeing your family for several years is a "humanitarian" cause. Technically the AP is supposed to be used as a travel permit for difficult situations, but most good Americans know that not seeing family for years is a good enough reason. There are jerks everywhere and type A's, thankfully they are not in the majority.
I had similar experience 4 years back, the officer was a A$$$#^%, I answered all his questions, gave EVL (I was working for Fortune 10 company). He kept on grilling me, I asked him to call his supervisor and also offered him to call my lawyer and then he backed off. I noted his name and his ID number etc.
But screwed me big time, he entered wrong I-94 number in his system, after a year when my company applied for extension, the application got RFE for non matching I-94 number etc. Everything went fine(lawyer had to file I-121 for lost I-94, but the extension took about 6 months to get approved.
While the extension process was going on, I with the help from my company lawyer filed a complaint to CBP against the officer and later the officer was transferred (As per my lawyer) to some other desk duty.

I visited the PA DMV yesterday to renew my driving licence based on my pending I-485. With all the valid documents like EAD, I-485, SSN card, I-94 etc. They refused to renew it saying that they have a new pilot program implemented called SAVE and need to get clearence from that, it will take upto 30 days. Anybody else gone throgh this proces?? Day by day more hurdles to pass...what a life, why dont they keep their systems uptodate or provide some temp permit as long as their check is pending. I am frustated with all this GC process, name check, DL SAVE system check etc..Why dont they implement just one check and give approval to everything.. atleast make it less time consuming.

I cant tell you how much i was moved by the momentum that got generated during the 'black' weekend before christmas. One can tell the excitement and enthusiasm among the sufferers in this community. I wholly appreciate the efforts taken in setting up this site and following up on the issues. We need to generate the same kind of membership as we saw during that weekend.
One question i have and many others like me would be interested in knowing is a clear description on how the money collected will be spent. I understand by reading your posts that it will be totally transparent and will be detailed out every week. But its more important for people to know before hand on how and why money is needed, before they can open up their purses generously. Also please take this question in a positive attitude as more people would know the actual reasons.

Looks like you forgot the intense pain of what you claim to be "agonizing 5 years" in no time. If DOL were so particular in doing things on time and keeping up their promises then it wouldn't have taken 5 years for your labor to clear. With all due respect, please stop telling us about DOL deadline...it holds no ground.
We understand Immigration Reform Bills being discussed currently and the need to focus on them...however, only thing we (BEC victims) are trying to put across is that if someone from IV does get the opportunity to speak infront of the congress, please don't forget to highlight the BEC mess (PBEC in particular). Labor certification backlog is one big part of the whole broken immigration system. It can not be isolated. Even if it is administrative problem we need the lawmakers attention to get it fixed.

I can understand the emotion and commotion among my fellow beings who are stuck with BECs. I waited agonizing 5 years to get my labor cleared. We all clearly understand what are you guys going through.
But the thing is that Labor Certification issues are taken care with PERM implementation. Also the administration set up 2 BECs to take care of them back logs. Now the issue is purely administrative and not law making. Also BECs made it clear that by Oct 2007 all the back logs will be cleared.
Right now big things are happening in the immigration law making. So I think we should concentrate to get the best out of it and achieve our goals on the Green Card Visa issues. As Tom Tancredo is going to fight with teeth and nail against Immi Bills, we have to do the same.
There are many others issues we can lobby for such as
1) Starting H1B stamping inside the US again( Which was stopped in 2005)
2) Allow H1B spouses to work. etc etc
But I believe our priority for the time being should be Retrogression. I request all of you to use this thread for finding a person to testify.

This bill is addressing number 1 above NOT number 2. The above scenarios reflect the current system not the future merit based or whatever else. I am assuming a case where an applicant continues under the old system.
If anyone disagrees please substantiate.

although this doesn't fit 100% to your case. You may want to look at the attached administrative appeals office decision.
Essentially, a person was denied in eb2 because they had a 3 yr bsc and 2 year masters. they had education evaluationstating that masters indian degree was equal to us masters degree.
nebraska service center stated that 3+2 is not equal to masters degree. Admininstrative appeals office decision approved it saying that it didn't matter how long the combined study was. As long as foreign masters equals us masters then that is all which needs to be proven.
My experience has been that texas service center sends an rfe for this 3+2 education. I know of 8 cases where thie decision was shown in the rfe and they all 8 got approved. I know of one case in nebraska where this case was shown and they still denied it stating that it wasn't a precedent decision (person already had another 140 denied and there was some history in his case which i believe caused nebraska to deny it). Odd part was that the appeals office decision was from nebraska service center
