Kaka you really have a win-win situation. If somehow something gets passed in lame duck then you will be happy with your GC. if nothing happens and priority dates don't move forward then you can always tell others " I told you it is scam and you did not believe it".

There were 1M+ EB GC applications as of March 2007 (when Ombudsman's report was written). There will be 1M additional applications by Aug 17 2007.
Lets assume a very conservative #: 1.4M by Aug 17. Then, 1.4M/140K = 10 years minimum.

most of you seem to presume spillover from future years flowing to India- is that guaranteed? how abt a surge of armenians or bangladeshis using up row #s, which I presume at some point will start moving and head toward C much much faster than India..we're all basically screwed & will be responding to rfe's on retirement day which will be truly sad if/when we have same/similar job then....

According to the regulations, USCIS errors cannot be considered as valid immigration benefits. Ask your attny to confirm if the approval is not in error and decide what to do next

Like you I had been waiting since 2005 (when my labor and I 140 got approved) for my PD to be current. Now that its been current since October 1, 2008 and even had been current in few months in early 2008 I realize that its just one more wait.
Nothing is going top happen by increasing quota unless USCIS speeeds up processing and decised to process based on a documented criteia (right now its completely random as TSC and NSC are out of synch and neither seems to follow any sequence of PD, ND or RD).
Me and others like me have been waiting since 2001 and we are still stuck even though PD is current. We have a special thread for us who are pre OCt 2001 PD and are still waiting. So if anything focus on getting USCIS to process orderly and efficiently. If you increase quota but dont change USCIS behaviour you will be worse off.

Call your local congressman or Congresswoman and Senator. They will help your case. My friend was in same situation and they helped him. He got his GC in 2 months after calling his congressman.

This is a very sad for EB3, there is no movement since 2004 Dec except 2007 fiasco. Our best option is right now to send a letter to local congress member and Senator. Tell your story in the letter. When did you come, what is your investment, future investment, career stagnant and our life is hanging in the middle of no-where. I will suggest to everyone to send the same letter to Local news paper also. At least you will see some kind reponse from politician here. I have alwyas receive a response from house members and senators. I think we should send the same letter to Ombudsman too. This is my thoughts. If gorup have some other idea. Please let us know.

Yes, there are laws that protect you regardless of your immigration status but how many H1 workers (who btw are non-immigrants, not immigrants) can we find here who have actually gone to the courts? Protection is really limited for an h1 worker. Your status in the country depends on your employer what are the chances you will sue the employer?

Even if you are an immigrant but as long as you are subject to the law of UnitedStates you have every right to fight discrimination and other actions that you percieve are illegal. Even Illegal immigrants can do that. It is there in one of the ammendments.

Its illegal for an employer to charge for H1B. You cannot expect employee to know and enforce the law. Employers know its illegal to charge money and in this case his employer is in violation of law.
I wasn't moral policing, I was just laying out the legal stand that anybody can have under these circumstances. I am sure that the so called "Desi shop owner" is not so dumb to so flagrantly violate the law when his employee is going by the book, unless the employee is seriously gullible.

If our parents stay in US, US economy will improved. We will be buying health insurance and food for them.
We will stop sending money to our native country. All money we earned will be spend here. We will be travelling more. Shopping more. etc.
This will help to improve US economy. I want to see US become super country like how it was when Bill Clinton was president.
We have a great present now. I was impressed by his speech about family value and raising kids together as family. I am sure, we will get help from him.
You know, How J2 visa holder got permission to work in US. A person fight for it and got it for many.

You do not have to copy the USCIS. Be nice and polite. Explain that you applied for EAD more than 90 days ago. Provide your I-765 receipt number.
Ask them to follow procedures in Aytes memo. Show the memo. Ask them to contact NSC where your I-765 is pending and alert them about your situation. (Contact NBC or Service Center to initiate EAD production—either Interim or Non-Interim). Ask them to provide Notice to you acknowledging status inquiry. If IO refuses to do that, ask to talk to the supervisor and repeat the above. It works. Basically, the federal regulations require them either to issue EAD in 90 days or issue interim EAD.
