My friend sent me through wire transfer. I think bank was HDFC.
He had't get RBI clearance or anything and he sent under maintenance category or something like not sure.
It was done in 2005 not sure rules are changed lately.

While some members might have jumped too hard on the whole thing, Some stuff goes unanswered.
1) Why has not USINPAC endorsed IV all this while on their website? Does not USINPAC know any thing about IV?
2) While I understand the importance of fund raisers for politicians, why USINPAC has not involved US citizens of American origin to contribute to the cause? What about grass roots efforts?
3) I dont have the exact statistics, but I am positive that every one out of 2/3 Indians living in the US is plagued by this problem of GC. How come Orgs like USINPAC are not pushing this by all means?

Dude,
I am facing same issue....need to get some money back from India....and there is no way i can get it officially without losing significant part of it. It is really illogical to send money to India for property investment just because we cannot get money back.....I am repenting doing that....
Whenever I ask my friends to do this favor to me.....all they say is they dont have money to send India (since they dont want to disclose their worth to me) or they dont want to send money to India since they know it is useless to send money at such a bad conversion rate.
If you can find some better way, let me know too.

I think u guys are getting anxious and thinking of such ways. u will need some determination to complete the MS besides ur regular work.......suppose if EB2 gets clogged suddenly next year, will u stop doing MS then?

Help them if you can and if you dont want to help then dont. Let them figure their way out, Believe me they will figure out a way to do MS for less and online. In any case EB2 getting clogged will not effect these people because EB2 dates might not progress but will not go back and if these people complete their MS and get a job which sponsers them in EB2 they become current according to their EB2 qualification.

that such approvals would be due to visa number allocated to a persons case when the visa dates were current. or allocated to prevent visas from being unused in the FY 2007. It may be an unlikely that such approvals (without PD being current) will continue in the 1st 3 quarters of FY 2008. Also it would be very safe to issue EB GC visas to ROW applicants as most likely they wont hit per country limit.

I agree with what most of the people here have said. The US economy is in a bigger hole and people buying houses isn't going to save it. It is going to take some creative and strict solutions from the Fed and the Govt to get the economy out of this mess.

I485 deniel email : 25/2010
I did not change attorney in file from company B for I485 .
Called companyB attorney on 2/5/10 and they did not even know that I left companyB .
They said they have not received any communication about I485 and they can deal with me for my 485 directly . they said they will call me once they receive the original letter (not suer wheter attorney get it or myself get it ).
So this is where I am standing .
So if my original sponser ( company A ) revoked 140 , should it not say the status denied/cancelled etc at that time ( 2-3 years ago) ?
If I had known that I would have shifted from companyB or would have looked for a H1 transfer. ( Just my lack of knowledge) .
Hopefully it is a string Ac21 mis-understanding issue. otherwise I may have to look for a H1 tranfer ( pain again)

I thought we must get ready with some reasons, when using AP to re-enter US. I have come up with some of my own that I may use:
1) Grandpa or Grandma is sick (most common reason, perhaps no body uses it as a reason anymore)(bona fide personal reason)
2) Land dispute (bona fide business reason)
3) Parents home need urgent repair (bona fide business reason)
4) Water shortage problem (bona fide business reason)

The immediate reference to illegal immigrants right after mentioning high tech workers does convey a link between the two, no matter how you slice and dice the semantics.
This is what I wrote to the editor, in response:

You cannot keep GC out of equation when GC/non-GC decides your ability to get unemployment benefits, choice of jobs and many more aspects of your life.
If you leave the country, you lose the equity on the house. I don't know when you bought
the house. In the post credit bubble period, the lender will make sure you have enough equity that they are secure and you have skin in the game.
Bought my home in early 2008 on 100% financing (yeah, they had these crazy schemes back then!) before the economy tanked. So I havent put down any money. Even the closing costs were paid by the seller. For me its not an investment, but a place to live. So I am not worried about the equity. The home isnt a McMansion and the mortgage payment is manageable. When tax savings at year end are considered, it almost puts me on par with renting.
On the other hand, I dont put GC on a pedestal. I bought my home even before I had started GC process. To me it is not a life changing event like the day I was born or my wedding day or the birth day of my kid. Its something good to have for obvious benefits, but I am not holding my breath until I get it. Once again, I reiter that factoring GC into your decisions is a personal choice, and I dont do it. I am not banking on unemployment benefits or any other govt dole. Like I said, if anything were to go wrong and I had to leave the country for good, my lender will be the one taking the hit. This might not be the case in your situation and I can understand why GC would be so important then.

For instance EB-3, numbers re-captured didn't all go to EB-3. The amendment gave 61,000 to Schedule A and then re-distributed the rest equally.
A much fairer, simpler and permanent solution is to simply rollover the unused numbers to next years numbers.
I believe there is around 300,000 unused visas from previous years. Even if 61,000 visas are gone to Schedule A, we would have got the remaining 240,000 visas. Imagine they are not even ready to pass the amendment which gives relief to Schedule A(extremely shortage workers) as well as employment catagories, think about the chances if the amendment stands only for employment catagories.

You are correct. The rules must have changed recently. I wonder what made them make that change, Now children of US citizens (who were once Indian citizens) have an advantage over children who has both parents as Indian citizens. Weird.. isn't it?

Hence how can he be allowed to take OCI when he infact can get primary citizenship? Also the rules are created with rules for all countries in mind not just USA and also they are intended to protect those who lived in India, paid taxes in India and these rules are to protect interests of children born in India.

gc101, if you are not able to get married before you you file your I485 (by Aug 17th).
One of my friend asked Shiela Murthy and she said that in order to be able to add my spouse , I would have HAD to get married before July 31st (which I couldn't anyway), because, then, only I/we will be eligible to add my spouse.
Also, I sent in the papers for my I-485 last night. Now, hoping to god that there is an RFE on this and some kind of delay.

I filed for my I-485, EAD and AP on July 2nd at the Nebraska Service Center. I am EB2 with a PD of June, 04. I haven't received any receipt notices. Any one in the same boat/ who has been through this process would like to share their views? Also, given the current fiasco, by when should I expect finger printing notice and, realistically, the green card?
