Yes, that is perfectly correct. If an employer needed somebody with BS and 2 yrs exeperience, and no US person applied. You (with a BS and 2 yrs experience) applied. Employer filed your I-140, which is approved. Now you wait for 4 years, and in the meantime you get your MS. Technically, you are now overqualified for the position, and employer may decide even not to consider you any more (leave alone upgrading to EB2). Note that entire process is for future employment after you get your GC, until then if you are working, you are working as a guest worker.

It's still regarding I-140 application.....I wanted to ask you if you need all employment letters that are written on Labor Ceritificate..or is it enough to submit only a few not all the employment letters for every job that was written on Labor certificate?
How is it working?

My original "Reciept notice" of 485 came from "California service Center" then few weeks i got another notice of action notice type = "Transfer Notice" that said your application has been transfered to "Nebraska service center".
For EAD renewal should i send copy of just Receipt Notice or both?
Also should i send the EAD renewal app to "Texas Service Center" as per instructions because i live in MA ?
As per section 7 of the instructions "with a copy of the receipt notice or other
evidence that your Form I-485, Application for
Permanent Residence or Adjust Status, is pending"
So you should send a receipt notice and that should be enough.
But for the heck of it, it does not matter if u send that transfer notice.
USCIS will not create any issue for you, just because u sent TOO much documentation. Here we are talking only about 1 extra piece of paper.

I am not sure how encouraging it will be for you to hear about some of our friends in tristate area.
Pretty much like you (Desi employers, 80/20 or 70/30 arrangements, found contracts through dice/monster/hotjobs, filed in jul 07 fiasco and AC21'ed off to full time positions). There is nothing wrong with these arrangements but unfortunately they are considered pretty much illegal from the H1b & immigration point of view.
Employers of many of them who have received their GC and many who are pending are currently being investigated. First they closed the gaping hole called substitution and now they are after all these sketchy employers and the petitions pending/approved through them.
It sucks for people whose petitions have been approved and are now trying to crystallize their lives by buying homes, etc. Administration holds the trump card in that they can revoke GC/citizenship anytime.
Few of these desi employers were nice enough to notify the beneficiaries. Many of these cases involve people who filed for EB2 i-140 to capture their EB3 dates after changing employers.

Only reason Attenborg's Gandhi was so magnificient is ...because it was an outsiders view on the life of gandhi...a less attached view of bapu's life.
If a desi had made that movie he would be overcome with his personal view of gandhi..
the movie on Gandhi is a masterpiece and slumdog is a piece of shit.
Credits to rehman for being brilliant as usual...but deifinitely this is not his best.
Slumdog made it to oscars only because a white dude directed it...if a Benegal or Mehra had directed it..it would never have made it past the shore..
My question to all the white trash out there..why are they so fasinated/amused by the poverty in asia or developing country.

When applying for CP the consulate we can apply to...does it have to be only the one in your home country (American Embassy in Chennai) or can it be the one in the country of last residence.
I have studied and lived in Canada for 3 years before coming to US. I am wondering if i can choose American Embassy in Montreal as my consulate post (country of last residence) or is my option just the consulate post in country of birth
Any thoughts on this greatly appreciated!!!
